PHILADELPHIA -- January 6, 2004 (TomFlocco.com) -- On Friday, Philip J. Berg, attorney for 9-11 widow Ellen Mariani in her Racketeer Influenced and Corrupt Organizations Act (RICO) suit seeking to hold President Bush and various government officials accountable for the September 11 attacks, served Bush and top officials in his Administration with a personal summons, the original complaint and the first amended complaint via a federal process server, as required by the Federal Rules of Civil Procedure.
Among those served besides the President, were Vice-President Richard Cheney, Secretary of Defense Donald Rumsfeld, Attorney General John Ashcroft, Central Intelligence Agency Director George Tenet, National Security Advisor Dr. Condoleezza Rice, Secretary of Transportation Norman Mineta, 9-11 Congressional Victim Compensation Fund Special Master Kenneth Feinberg, former Iraqi Dictator Saddam Hussein, Zacarias Moussaoui, and former President George H. W. Bush.
The legal documents were also filed at the Philadelphia office of United States Attorney Patrick Meehan, former Republican District Attorney from Delaware County, Pennsylvania.
Berg told TomFlocco.com “the multiple summonses and complaints were filed last week in Philadelphia; and they require an answer within 60 days,” adding “we feel confident that we’ll be successful, and that the evidence in this case is so strong, it will lead to the end of the Bush presidency.”
Berg also told us “we’re currently preparing written interrogatories and subpoenas so that we’ll be able to keep the discovery of evidence and multiple investigations moving forward at a reasonable pace.”
For her part, plaintiff Ellen Mariani told us last night that “There was ample warning of these attacks; and now I hear from news reports that Condoleezza Rice doesn’t want to testify publicly under oath about all the intelligence briefings which warned about planes flying into buildings. What does she have to hide?”
The widow continued, “Our Congress created new laws to protect themselves, the White House and the insurance corporations. Insurance lobbyists even talked to representatives and senators on the afternoon of the attacks.”
“And then Mr. Ashcroft’s lawyers stalled the New York City airline and airport security lawsuits and investigations to force destitute victim families into the Federal Compensation Fund. But they had to sign an agreement promising never to sue the government about 9-11 evidence,” she said. “So I decided to file another suit; but this one includes everyone.”
WTC BUILDING 7: THE PROBLEM THAT WON’T GO AWAY
In a related 9-11 evidence matter, anyone keeping an ear to the internet chatrooms and independent 9-11 websites will discover much discussion regarding another problem about which government officials may have to provide a public answer in a court of law: evidence contrary to the official Bush Administration storyline regarding the manner in which the World Trade Center buildings collapsed.
Bubbling under the surface of worldwide internet communication is incredible evidence in the form of video, photography and careful analysis that is convincing enough to merit criminal scrutiny by experienced federal prosecutors.
Careful inspection of the video and photo evidence of the collapse of the twin towers--and particularly WTC Building 7--along with some important, early ground-breaking reporting by Christopher Bollyn of American Free Press, reveals that the buildings may have been destroyed by controlled demolition.
Independent citizen investigators with related expertise have provided careful analysis of the Federal Emergency Management Agency’s (FEMA) report attempting to explain away the strange collapse of building 7 at the World Trade Center. Multiple photographs and video clips expand and strengthen the strong implications supporting the case for implosion instead of fire-induced collapse.
Government officials may be forced to refute this evidence as it could to find its way into Philip Berg’s next amended complaint--and ultimately into the courtroom in Philadelphia. This, as busy staffers sit down and examine the implications of the findings as a possible presidential campaign issue in Iowa, New Hampshire, South Carolina and other early primary states. The evidence is that devastating.
COLLAPSED INVESTIGATIONS?
That the manner of WTC Building 7’s collapse is an intriguing and compelling 9-11 issue in and of itself is only amplified by the fact that the National Law Journal (9-17-2001) revealed that details are emerging about the effect of “the collapse of 7 World Trade Center on investigations being conducted by the New York offices of the Securities and Exchange Commission and the Equal Employment Opportunity Commission, both of which were housed in the building.”
According to TheStreet.com (8-9-2002)--principally owned by Jim Cramer of CNBC’s Kudlow & Cramer: “The chairman of the House Financial Services Committee, frustrated by Citigroup's unwillingness to turn over information about any WorldCom executives who may have gotten shares in initial public offerings, will try to pry the information out with a subpoena.”
The Journal added that “the SEC has not quantified the number of active cases in which substantial files were destroyed. Reuters news service and the Los Angeles Times published reports estimating them at 3,000 to 4,000. They include the agency's major inquiry into the manner in which investment banks divvied up hot shares of initial public offerings during the high-tech boom.”
"Ongoing investigations at the New York SEC will be dramatically affected because so much of their work is paper-intensive," said Max Berger of New York's Bernstein Litowitz Berger & Grossmann. "This is a disaster for these cases," also reported by the National Law Journal.
Cramer’s website revealed that “Rep. Michael Oxley (R., Ohio) said that a subpoena is necessary because Citigroup provided insufficient information about what, if any, special treatment its Salomon Smith Barney investing banking division may have given WorldCom executives. Salomon had been one of the now-bankrupt telecom's principal investment bankers.”
But the financial website also said that Citigroup says some information that the committee is seeking was destroyed in the Sept. 11 terror attack on the World Trade Center. Salomon had offices in 7 World Trade Center, one of the buildings that collapsed in the aftermath of the attack. The bank says that back-up tapes of corporate emails from September 1998 through December 2000 were stored at the building and destroyed in the attack, according to Matthew Goldstein’s report.
When asked about the emerging evidence connected to the collapse of 7 World Trade Center, Mariani said: “3,000 murders, and after more than two years, no one has been brought to trial and no one has been held accountable. Do they think I’m going away? Do they think they can pull the wool over my eyes?”

Shortly after 10 am, when the first of the World Trade Towers collapsed, this exchange occurred between ABC News’ Peter Jennings and a reporter at the scene:
Don Dahler: Yeah. It's Don Dahler. The second building that was hit by the plane has just completely collapsed. The entire building has just collapsed as if a demolition team set it off--when you see the old demolitions of these old buildings. It is not there anymore. It has completely collapsed.
Peter Jennings: The whole side has collapsed?
Don Dahler: The whole building collapsed.
Peter Jennings: The whole building has collapsed?
Don Dahler: The building has collapsed.
Peter Jennings: That's the southern tower you're talking about.
Don Dahler: Exactly. The second building that we witnessed the airplane enter, has been--the top half had been fully involved in flame. It just collapsed. There is panic on the streets. Thousands of people running up Church Street. That’s what I'm looking out on, trying to get away. But the entire -- at least as far as I can see, the top half of the building, at least half of it--I can't see below that. Half of it just started with a gigantic rumble, folded in on itself and collapsed in a huge plume of smoke and dust.
